Environmental and water rights counsel for Pinnacle West Capital Corporation and its primary subsidiary, Arizona Public Service Company (APS), providing environmental, permitting, enforcement, litigation, and business planning advice to clients across the enterprise, including issues arising under the Clean Air Act (CAA), Clean Water Act, Resource Conservation and Recovery Act, and Comprehensive Environmental Response, Compensation and Liability Act■ Counsel APS’s corporate environmental department and executive management regarding compliance and reporting requirements pertaining to air emissions, surface and subsurface discharges, and hazardous substances under local, state, and federal laws, rules, and regulations■ Provide counsel to APS business units regarding compliance with federal and state programs regulating the disposal of coal combustion residuals (CCR) in CCR surface impoundments and landfills, including serving on company’s CCR Steering Committee to coordinate CCR compliance efforts across APS’s environmental, engineering, and fossil operations units■ Develop strategies for proceedings or settlement respecting all aspects of the company’s state and federal environmental litigation, including negotiating settlements with the United States Department of Justice and United States Environmental Protection Agency (EPA) on New Source Review and regional haze litigation■ Strategize with executive management and APS business units to develop company’s position on EPA’s proposed Clean Power Plan and engage with state and federal regulatory agencies, affected utilities, and stakeholders regarding the development of state and federal plans to implement and enforce the CAA Section 111(d) standards■ Track legislative and regulatory changes potentially impacting the company and analyze and draft rule-making comments■ Advise and counsel clients on enterprise and business unit environmental strategy and policy and other business and legal matters

■ Worked exclusively as on-site contractor at APS to negotiate and draft $900 million long-term reclaimed water supply contract for Palo Verde Nuclear Generating Station■ Provided consultation to APS on a wide range of water rights, permitting, and compliance issues regarding numerous aspects of water supply and development, including securing water rights and supplies, planning for the use and protection of water rights, and effluent recharge and recovery

Shareholder ■ Represented utility clients in multi-state rulemakings concerning the regulation of emissions from coal-fired power plants, the development of state implementation plan provisions to reduce regional haze, and the regulation of excess emissions resulting from startup, shutdown, and malfunction events■ Advised electric utilities on issues involving compliance with EPA’s New Source Performance Standards and NSR programs, including project segmentation; facility co-location; routine maintenance, repair, and replacement; fuel switching; and the triggering of regulatory requirements resulting from the debottlenecking of operations■ Worked with state permitting agencies to secure NSR, Title V, and non-Title V air permits■ Represented and counseled clients in administrative actions and enforcement proceedings related to air quality violations■ Counseled clients on myriad environmental law and natural resources issues■ Reviewed Phase I and Phase II environmental site assessments to counsel clients regarding environmental issues associated with real estate transactions■ Negotiated and drafted complex water rights agreements for the sale and purchase of water, the conveyance of water rights, and the design and construction of water infrastructure projects
