I am the managing partner of Sullivan Stolier Schulze and have been practicing healthcare law exclusively since graduating from Tulane University School of Law in 1998. I regularly represent acute care, psychiatric, rural, critical access, LTCH, and rehabilitation hospitals, clinical laboratories, physician group practices, home health, and hospice providers both locally and nationally on a wide variety of federal and state healthcare issues. A significant portion of my practice involves counseling clients on regulatory compliance matters and defending clients in government investigations involving Anti-Kickback, Stark and false claims act allegations, as well as UPIC, TPE, and other provider audits. Drawing on the insight gained through this investigation and audit work, I regularly assist clients with evaluating potential compliance issues, conducting internal investigations, reviewing possible self-disclosures, and implementing and auditing practical, efficient, and effective compliance programs that are tailored to the client's operations and that provide valuable compliance documentation that become an effective deterrent to government investigations and prosecutions. I also work extensively with providers and physicians on a wide variety of regulatory matters, including: - entity financing, formation, licensure and enrollment, transactions, and joint-ventures; - negotiating and drafting employment, recruitment, medical director, call-coverage and other physician and nurse practitioner agreements that comply with Stark II and Anti-Kickback laws and regulations; - documentation of fair market value and commercial reasonableness determinations; - entity licensing, enrollment, conditions of participation, Joint Commission and other deeming agencies;- governing board bylaws and compliance education on obligations and documentation; - EMTALA and HIPAA compliance evaluation and resolution of issues;- medical staff bylaws drafting and modification; - provider based entity/department formation and attestations; - other Medicare and Medicaid matters; and - managed care issues involving contracts, audits, payment rules, etc. Health care law is what I was always drawn to and I have made a career out of that constant interest and curiosity and ability to evaluate and solve client problems as they arise.
