Supporting Section 337 Investigations before the U.S. International Trade Commission and Patent Litigation in Federal Courts

Responsible for a global intellectual property portfolio for industry leader in cloud- and premise-based contact center systems and software, working directly with the Chief IP Counsel. Duties include:• Preparing and prosecuting patent applications before the USPTO. Working with engineers and developers in converting invention disclosures into patent applications.• Managing and supervising outside counsel on IP matters, including managing budgets.• Providing internal training on IP best practices across multiple business units.

Associate in intellectual property practice section. Summary of recent work includes:• Evaluation of underleveraged intelligent video surveillance patent portfolio for potential monetization campaign against foreign manufactures including ITC campaign. Analysis required full portfolio review for best assertion candidates, rendering patent infringement opinions, and conducting a patent validity analysis. • Member of International Trade Commission litigation team. Work encompasses all phases of litigation, including pre-filing diligence, discovery, technical and expert depositions, pre-trial briefing, and post-trial briefing. Technology includes multiple investigations on components of mobile and tablet devices, mobile operating systems, flat panel displays, and RDIMM modules. • Partnered with medical device company specializing in developing endosurgical tools and imaging solutions. Collaborated on comprehensive strategy for patent portfolio and evaluating potential licensees. Strategy included patent litigation against competitor in endoscope space. Oversaw day-to-day operation of the case, including developing claim construction, infringement, and validity positions, and handling discovery and motions practice.• Arbitration trial team member centering on dispute over development of patented custom orthotic insole. Achieved substantial settlement win for client mid-hearing. • Drafting petitions for Inter Partes Review on medical and biomedical devices, including providing invalidity opinion in view of prior art.• Deposed technical witnesses in Hatch-Waxman action involving multiple Orange Book-listed patents for the drug Livalo. • Conducted due diligence on patent portfolios for potential acquisition/investment by clients.• Supporting firm pro bono program through defending DC Legal Aid housing eviction cases. Achieved significant win for client facing eviction by asserting housing code violations against property management.

Associate in Litigation and Dispute Resolution Practice Section and Electrical Patent Practice Section. Practice focused primarily on patent acquisition and intellectual property defense strategies. Litigation work encompassed client counseling and case strategy, motion practice, discovery practice and management, expert discovery, as well as Markman and summary judgment briefing and argument. Litigation matters included:• Defended respondent marine electronics company in ITC investigation. Oversaw day-to-day management of case, including discovery production and review, motions practice, coordination with expert discovery, as well as deposition preparation and defense.• Defended respondent wiper blade manufacturing companies in ITC investigation. Oversaw day-to-day management of case, including discovery practice, motions practice, expert discovery, Markman briefing and argument preparation, as well as fact witness depositions.• Represented hearing aid company plaintiff on digital signal processing patent. Work included conducting fact and expert discovery, taking depositions, as well as drafting motions briefs. Argued Markman hearing, with court ruling in client’s favor on all disputed terms.• Successfully appealed to Federal Circuit from Board of Patent Appeals and Interferences arguing “error” under reissue statue included omission of claims of narrower scope. Principal author on brief. Mooted arguing partner. • Performed non-patent litigation work including five-day bench trial on insurance fraud matter, contract actions and collections work in Virginia state and federal courts. Practice also included a patent prosecution docket, patent application drafting, and licensing work. Prosecution technology included refrigerators, copiers, displays, electric car batteries, stents, farm implements, and apparatuses for manufacturing semiconductor chips and drying powder.

Participated in BSKB's Summer Patent Seminar (formerly Summer Training Program)

Conducted legal research on complex civil litigation issues, including medical malpractice, legal malpractice, toxic tort and contract claims. Drafted opinion memoranda and orders.

Worked directly under supervising public defender on clients facing murder, kidnapping, child abuse and sexual assault charges. Responsibilities included legal research, writing motions and legal memoranda, case planning, investigation, as well as preparing for trials, hearings and sentencing.
