I'm a litigation and dispute resolution lawyer, primarily involved in civil litigation. This includes contract claims, estate or trust claims, property or leasing disputes, and debt recovery.While no claim is exactly alike and the process differs depending on my client's preferences and the type of dispute, a possible file could look something like this:My work usually starts with meeting clients (in person or sometimes by phone or video call) to discuss their disputes and understand what they want to achieve. I can give advice in that meeting, or for more complex matters or where I need to review documents, I can give advice in a second meeting or email. The next step may be a letter of demand or cease and desist letter.If that doesn't work, it may be time to go to the relevant Court, Tribunal or alternative dispute resolution process. I know how to structure and present a claim for the best effect, and when there may be "fast-track" options such as an application for Summary Judgment.Throughout this process I can be involved in settlement discussions and negotiations with the other party or their lawyer. Sometimes the Court will direct that a Judicial Settlement Conference (a mediation held in front of a Judge) is held, which can be an excellent reality-check for parties that might not understand their risks.Once a matter is filed in Court I will manage the process and the steps that must occur before a trial can occur. This includes discovery and exchange of documents, ensuring that the legal issues involved are clear and well defined, and making sure that my client has all the evidence they need to overcome any defense that is raised.Prior to hearing we will prepare briefs of evidence for witnesses, arrange bundles of documents, and prepare for cross examination of the other parties' witnesses. We will also prepare a summary of our legal submissions explaining the relevant law, and cross referencing to the witness statements and documents to show why the evidence should result in the outcome we want. We will also prepare our client and their witnesses for the Court experience.In Court I will present my client's witnesses and evidence, cross examine the other parties' witnesses to undermine them where needed and give verbal submissions about the facts and law to the Judge, expanding on my written summary of submissions. I thrive on discussing the case back and forth with the Judge and fielding difficult questions. I have experience with hearings ranging from a single day to more than a week.
