About Neil Forester

The pandemic reframed my professional outlook. Our family law court system is not built for the advances we've seen in technology in recent years and struggled to adapt to the forced transition to remote dispute resolution. Mediation, arbitration and private judging solutions can provide a best-case option for couples seeking efficient and cordial outcomes, with or without lawyers involved. Through a virtual business model, I extend these tools to a broader clientele while maintaining my focus on client service. SNAPSHOT: Serving as divorce litigator, arbitrator, mediator, private judge, consulting attorney, and pre-litigation strategist, I blend creative ADR methods with advisory counseling to help clients resolve divorces, parenting disputes, and other family law conflicts — outside courtroom confines whenever possible. Formed in the shadow of the limitations brought on by COVID-19, my primarily virtual law firm prioritizes private and accessible solutions by emphasizing remote engagement with clients and the courts. Face to face meetings remain a valuable option in addition to the efficiency and cost-effectiveness of a more tech-based approach.Certified Family Law Specialist (CFLS), certified by the State Bar of California Board of Legal SpecializationEXPERIENCE. Over 18+ years, my work has covered marriage dissolution, complex business characterization/valuation and property division, child custody orders, child support calculations, and spousal support awards. I also help individuals with prenups, adoptions, cohabitation agreements, LGBTQ+ legalities, and pet parenting contracts. A portion of my time is donated to DV survivors, with a focus on safety planning. SERVICES. Because I have spent much of my career negotiating and litigating divorce cases, I can offer expertise and an insider perspective about the realities of family court. My practice emphasizes mediation and arbitration whenever possible as a more efficient alternative to lawsuits, court hearings, and expensive lawyering. When litigation is unavoidable, I provide specialized counseling and representation in the courtroom. neil@foresterfamilylaw.com EXTRAS. Beyond my practice, I serve on the board for NorCal Boxer Rescue. In 2022, I joined ProVisors as Group Leader of SAC1. Some of my pastimes include the daily NYT crossword, discovering new foods to smoke/sous vide/torch/bake, early mornings cheering for Tottenham, and hanging out with my wife and our Boxer dogs.

Certified Family Law Arbitrator / Aaml Fellow

    Chicago, Illinois, Us
I am certified to arbitrate family law cases by the American Academy of Matrimonial Lawyers (AAML), a professional organization of over 1,500 family lawyers nationwide. Academy Fellows must pass rigorous testing plus judicial and peer review to be invited to join. In California, fewer than 20 lawyers have acquired arbitrator certification through the AAML.With courts across the country dealing with large backlogs of cases due to COVID-19, clients and their lawyers may be best served through an alternative dispute resolution process such as arbitration. Arbitration can be binding or nonbinding and may be conducted before a panel or a single arbitrator. Arbitration was first used in the US in labor and commercial law, but the use of arbitration in matrimonial cases has been steadily increasing. It is well-suited, not only to divorce cases, but also to matrimonial appellate review and modifiability of spousal support. An arbitration can follow the formal rules and procedures used in litigation or, if both sides agree, the rules can be modified to fit the case.Advantages include:+ The process is private as compared to the courthouse.+ The parties can choose an arbitrator with knowledge and skills appropriate to the issues in the particular case.+ The process provides a more convenient and reliable timetable.+ Arbitrators may craft a decision that is more suited to a case than a judge might.

Family Law Trial Skills was a brand new course that I was recruited to develop by one of the McGeorge Deans. I opted to immerse the class in a fictitious fact pattern from the first day of class, breaking the students up into teams representing one side or the other. The course was designed to teach the students how to develop a case strategy, discovery plan, and eventual trial approach from the first meeting with their client all the way through a mock trial presided over by an actual judge. The students were presented with actual clients and witnesses (including experts), in addition to manufactured documentary evidence to be presented at trial, and were encouraged to utilize the DissoMaster and Propertizer programs, as well as the most common Judicial Council forms (including the Income & Expense Declaration and Schedule of Assets and Debts). The trial judge issued a written ruling submitted to the students, and also provided helpful hints and tips from a bench officer’s perspective.
