I am also well-versed in the latest electronic discovery issues, often counseling clients on best practices for preserving, collecting, and producing information in response to subpoenas and document demands.Recent representative matters include:- successfully trying foreclosure of $5.4 million note and mortgage of a fraudulently-transferred bottling plant on behalf of debtor entity in bankruptcy adversary proceeding, and obtaining judgment for damages caused by fraudulent conduct of defendants;- defending major sign manufacturer in litigation alleging breaches of fiduciary duty against company’s chief executive officer;- representing 49% minority member, as claimant, in arbitration for breach of fiduciary duty against majority members of limited liability company for mismanagement of a commercial property and failure to pay a required preferential return;- representing major contact lens online retailer as a third party in FTC and follow-on class action litigation concerning competitor's anti-competitive conduct involving “paid search” online advertising;- assisting various investment companies and broker dealers in responding to SEC subpoenas and investigations;- suing former employee of e-cigarette company in Nevada state court for violation of non-compete agreement and other restrictive covenants;- successfully defeating jurisdictional challenge and securing $700,000 judgment and decision for highly-regarded New York restaurant in federal trademark and trade dress infringement dispute against California defendants

Representative matters included obtaining dismissal of ERISA claims against major insurance company; obtaining permanent injunctive relief against former broker for theft of confidential client lists and violations of a non-compete agreement; and successfully defending and achieving settlement for financial broker in securities case involving variable annuity insurance.

Represented clients in antitrust multi-district litigation involving largest U.S. payment card issuers, securities class action against officers and directors of a global telecom company, securities action against underwriter of auction rate securities, banker merger litigation arising from 2008 financial crisis, and internal investigations relating to violations of the Foreign Corrupt Practices Act. Also represented pro bono several indigent clients in state criminal actions and non-profit group in federal environmental lawsuit against the EPA.
