Patrick is an attorney with an MBA who acts as general counsel to several governmental agencies and boards on land use,, transportation, capital infrastructure, real estate development, and business law issues. Since leaving the NYS Senate in January, 2011, he has been working for the Office of the Nassau County Attorney handling a range of legal matters including major public improvements projects, bankruptcy litigation, land use matters, affordable housing projects, green energy projects, software licensing, hosting agreements, commercial transactions, and real estate transactions. Patrick has been involved in several high profile public capital improvements projects. He was lead counsel in the LIRR Main Line Expansion project, a $2.6 billion project which was the largest capital infrastructure project in LIRR history and first design-build. He also provided counsel concerning jurisdictional, subdivision, and zoning issues in relation the the Empire State Development Corporation's development of the Belmont Arena. He provided legal advice and public testimony concerning the implications of a Chapter 9 bankruptcy by a counter-party to an IMA with the County to the County Legislature involving a $77 million capital project to construct a subterranean viaduct for the transportation of waste from a city to a County waste treatment facility. As bankruptcy counsel, Patrick has scored some major victories for Nassau County. He recovered over $10 million in secured and unsecured claims as counsel. One of his major victories was a $1.8 million recovery of secured, unsecured, and administrative claims of a failed hotel in Long Beach, NY. He also helped keep the Islanders stay connected to their Long Island roots by acting as co-counsel in the bankruptcy sale of Twin Rinks at Eisenhower, which was sold to the Islanders and is now used as their practice facility. Some successful transactions include the first known successful purchase of real property through a foreclosure sale by a government entity in the U.S., numerous multi-million dollar software license transactions, hosting agreements, and banking services agreements. Patrick was appointed co-counsel to the Nassau County Planning Commission (“NCPC”) in January, 2012 and has provided legal counsel to the NCPC on many land use issues with a substantial impact on the County, including numerous major and minor subdivision applications, zoning referrals, and OSPAC cases. He also provided legal counsel during the approval process of the $130 million renovation of the Nassau Veterans Memorial Coliseum.

    The Nassau County Land Bank was established in 2012 pursuant to the passage of the New York Land Bank Act. The Act allows foreclosing governmental units (local units of government that foreclose on real property for delinquent taxes) to form land banks. Land banks are local public authorities, accountable to the units of government which created them, designed to acquire, stabilize, assemble, and facilitate the redevelopment of blighted and abandoned properties, in order for them to be returned to productive use and back on the tax rolls. Returning these formerly abandoned properties to productive use improves quality of life for surrounding residents and helps to grow the community’s local property tax base by encouraging renovation that improves the value of the property the land bank sells, as well as surrounding property values. There are now 28 land banks across the state working to proactively intervene and take control of abandoned properties. The mission and purpose of NCLB is to direct its funding and efforts to decrease the number of vacant, abandoned and tax distressed properties within Nassau County, having the effect of restoring such properties to productive use and revitalizing, improving, and creating value in the communities in which they are located.

    Co-counsel to the lead agency in the largest residential subdivision in Nassau County in over 70 years. The discretionary action involved a major subdivision application to the County Planning Commission with respect to the zoning compliant subdivision of a 117.62 acre golf course into 285 single-family homes. The subject property was located in 2 incorporated villages and 1 unincorporated area. This subdivision was classified a Type 1 action and required the preparation of a FEAF and the coordinated review of several involved agencies, including the villages, the Town of Hempstead ("Town"), the NYSDEC, and the Army Corp. of Engineers, A positive declaration was subsequently issued by the lead agency. The DEIS was subsequently scoped and the scope was approved at a public hearing. A DEIS was subsequently prepared by the developer and was determined by the lead agency to be adequate in terms of content and was accepted for public review. A notice of completion was issued by the lead agency and public comments were provided on the DEIS. Prior to the completion of the FEIS, the Town and the Villages down-zoned the property. Because of this, the developer commenced an action in federal court for, among other constitutional claims, an unconstitutional taking. Subsequently, this lawsuit was discontinued and the developer complied with the new zoning ordinances. Based on this, the lead agency adopted the Town's SEQR prepared for the change of zone. None of the lead agencies actions were legally challenged

The County Treasurer was a secured and unsecured creditor in this case and was owed approximately $2 million in real property taxes and hotel occupancy taxes. Subsequent to the bankruptcy sale, successfully moved to prime mortgagee who purchased hotel via credit bid and recovered approximately $700K in real property taxes. Negotiated a pre-bankruptcy settlement with hotel affiliate property owner to set off hotel tax arrearage with the hotel's tax cert refund. Recovered adequate protection payments and administrative claims for hotel taxes. Defended motion practice against IRS and NYS DTF concerning distributions and adequate protection issues.• Co-counsel in the Twin Rinks at Eisenhower, LLC chapter 11 bankruptcy case, representing the licensor of a failed recently constructed $50 million ice skating and training facility administered in the USBC in the Eastern District of New York. The case was successfully resolved through a sale process resulting in a sale to the owners of a National Hockey League franchise.• Co-counsel in the litigation of an adversary proceeding in EDNY with a large public contractor involving novel issues in 2nd Circuit law relating to maturity of claims and funds antecedent to an approved reorganization plan. After oral argument on cross-motions to dismiss, the court ordered mediation.     • Successfully dismissed a single-asset real estate bankruptcy case in the Eastern District of New York on a highly valuable commercial property located in the Roosevelt Field Shopping Mall and subsequently acquired the property via tax deed for the County. Pending state court action to quite title for eventual sale of the property. • Successfully dismissed a Chapter 11 case and related adversary proceeding in the Southern District of New York involving a super-fund site leveraged by over $20 million in county and village real property tax liens and open taxes, USEPA and NYSDEC environmental liens, mortgages, and other governmental liens. Dismissal granted as a bad faith filing and due to administrative insolvency. Dismissal allowed the stakeholder to act on a tax deed and redevelop the property in partnership with the village and county.• Litigated an issue involving a forbearance payment on a County tax lien held by a third party on a commercial property involving complex issues relating to the Nassau County Administrative Code on a section 363 bankruptcy sale. Negotiated an undertaking letter with the title company to hold County funds in escrow and negotiated an order protecting the Treasurer by deeming the third-party lien satisfied and ordering the Treasurer to accept less than full payment of the third-party portion of the lien to clear the lien from the Treasurer's books and comply with the Administrative Code and allow the Treasurer to recover $325K.
