Limelight v. Akamai.Yesterday, I was fortunate enough to attend (with my excellent partner, Sarah Paxson) the Supreme Court oral argument in this case. Limelight seeks reversal of the Federal Circuit en banc decision finding that Limelight can be liable for inducing infringement even if there is no direct infringer. Many of the justices were sceptical of the Federal Circuit's decision. I expect that they will reverse the Federal Circuit on narrow grounds leaving for another day the more difficult question of when direct infringement can be shown based on the combined actions of different legal entities.
