CurrentThe Advisings and Community Protection team provides legal advice and support to the Attorney General as First Law Officer in respect of their statutory and common law responsibilities, as well as other Ministers and the Executive in the Department of Communities and Justice in respect of legislation relating to the safety and protection of the community and contributes to reducing reoffending and maintenance of public confidence in the criminal justice system.The team also provides legal advice and support for all relevant executive and operational decision making across the Department and acts on behalf of the Attorney General in general litigation and prosecutions in which the Director of Public Prosecutions is conflicted.Key areas of practice include:♦ Review of sentences and convictions♦ Exercise of the Royal prerogative of mercy♦ High risk offenders♦ Forensic patients♦ Parole proceedings before the State Parole Authority♦ Parole proceedings before the Children’s Court♦ Segregated and protective custody orders for inmates in Corrective Services custody♦ Management of inmates, detainees, parolees or other persons subject to community supervision by Corrective Services and Youth Justice♦ Judicial review applications relating to administrative decisions by Corrective Services, Youth Justice and the State Parole Authority♦ Implementation of relevant legislation and governance arrangements to ensure multi-agency cooperation (in particular for serious sex and violent and terrorism-related offenders)♦ General legal advice and support on relevant legislation and matters within the portfolio responsibility of the Attorney General and other Ministers in the Department.
