Peter Archos is a Partner in Thynne + Macartney’s Business Advisory and Dispute Resolution Group, and specialises in commercial litigation with particular interest in competition and consumer law (formerly trade practices), intellectual property, contractual and liability disputes.In the competition area he has advised corporations in relation to mergers and acquisitions, manufacturer’s liability and compliance with the law. He has also negotiated directly with the Australian Competition and Consumer Commission (ACCC) at its highest level (the then Chairman of the Commission). He has also conducted the successful defence of a corporation in the Federal Court against the most serious of proceedings brought by the ACCC – an allegation of price fixing.In the field of intellectual property Peter has acted in numerous matters including the defence of a client against Federal Court proceedings brought in relation to an allegation of copying or reverse engineering the formula for a chemical used in the mining industry. Most recently, in the field of intellectual property, Peter undertook the defence of a national clothing manufacturer/retailer accused of copyright infringement. The copyright was in fabric patterns incorporated into women’s clothing.One of the largest pieces of litigation which Peter has undertaken arose out of a contract, specifically a joint-venture agreement. The litigation conducted by Peter related to the dissolution of the joint-venture which had assets valued at $150 million. Peter also advises clients in relation to their liability for breach of their duty of care or professional negligence. Recently he represented a party in the Supreme Court of Victoria in respect of an alleged breach of duty of care and negligence. Peter also assists claimants who have been affected by resumption of property and prosecutes claims for compensation in the Land Court.
