My practice focused primarily on patent litigation, with some Lanham Act cases (trademark and false advertising), defenses against agency enforcement actions, and other complex civil cases. • Lead counsel in patent infringement cases in many technologies, and second chair in dozens of patent infringement, other IP, and false advertising cases. Developed budgets and strategy, supervised junior attorneys and paralegals, and handled ADR and settlement negotiations.• Lead trial counsel for major tool and consumer products manufacturer accused of infringing a patent on LED flashlight technology ($25 million damages claimed). Defendants found evidence of intentional misconduct, and convinced judge to sever and try inequitable conduct counterclaims. Patent held unenforceable, and client awarded fees and costs.• Represented plaintiff in trademark infringement suit between major technology publishers. Argued preliminary injunction motion and handled mediation, securing favorable settlement.• Represented nutritional supplement company in civil contempt proceedings. Helped formulate expert reports and drafted opposition briefs resulting in published opinion denying FTC motion. • Conceived and wrote successful dispositive and non-dispositive motions. Successfully argued at hearings on Markman, preliminary injunction, discovery, and sanctions motions. • Prepared, examined, and defended fact and expert witnesses at deposition – including technical experts (infringement and validity), legal experts, survey experts (trademark and false advertising), and economists (damages and secondary considerations). Prepared witnesses for trial.• Developed expert reports and testimony in disciplines including pharmaceuticals, nutraceuticals, medical devices, mechanical, electrical, computer software, and biomedical. Cases included litigation over “block-buster” drugs (Neurontin® and Claritin®) and a false advertising case re supplements with over $100 million damages claimed.
