My practice focused on Hatch-Waxman/ANDA patent litigation and inter partes reviews (IPRs) of pharmaceutical patents. Representative clients included Apotex, Lupin, and Mylan. Litigated many Hatch-Waxman cases, including challenges to Orange Book-listed patents for Restasis®, Velcade®, Truvada®, Viread®, and Apriso®. Successfully argued at Markman and motions hearings.Helped develop and draft eight successful IPR petitions challenging Orange Book-listed patents for Restasis® and Juxtapid®. Designated back-up counsel in IPR proceedings challenging patents listed for Restasis®. Developed and executed litigation and IPR strategy while supervising junior attorneys, technical advisors and paralegals.Helped conceive and write summary judgment motions, many non-dispositive briefs and motions, and amicus briefs filed in the Third and Federal Circuit Courts of Appeal, and in the Supreme Court.Prepared witnesses for deposition, and examined and defended fact and expert witnesses at deposition on issues including infringement, validity, and secondary considerations of non-obviousness. Developed reports and testimony of technical and clinical experts in many disciplines.Supervised preparation of pretrial submissions, and prepared witnesses for trial.

My practice focused primarily on patent litigation, with some Lanham Act cases (trademark and false advertising), defenses against agency enforcement actions, and other complex civil cases. • Lead counsel in patent infringement cases in many technologies, and second chair in dozens of patent infringement, other IP, and false advertising cases. Developed budgets and strategy, supervised junior attorneys and paralegals, and handled ADR and settlement negotiations.• Lead trial counsel for major tool and consumer products manufacturer accused of infringing a patent on LED flashlight technology ($25 million damages claimed). Defendants found evidence of intentional misconduct, and convinced judge to sever and try inequitable conduct counterclaims. Patent held unenforceable, and client awarded fees and costs.• Represented plaintiff in trademark infringement suit between major technology publishers. Argued preliminary injunction motion and handled mediation, securing favorable settlement.• Represented nutritional supplement company in civil contempt proceedings. Helped formulate expert reports and drafted opposition briefs resulting in published opinion denying FTC motion. • Conceived and wrote successful dispositive and non-dispositive motions. Successfully argued at hearings on Markman, preliminary injunction, discovery, and sanctions motions. • Prepared, examined, and defended fact and expert witnesses at deposition – including technical experts (infringement and validity), legal experts, survey experts (trademark and false advertising), and economists (damages and secondary considerations). Prepared witnesses for trial.• Developed expert reports and testimony in disciplines including pharmaceuticals, nutraceuticals, medical devices, mechanical, electrical, computer software, and biomedical. Cases included litigation over “block-buster” drugs (Neurontin® and Claritin®) and a false advertising case re supplements with over $100 million damages claimed.

Office of the Staff Judge Advocate, XVIII Airborne Corps & Fort Bragg.Served as a Special Assistant U.S. Attorney in the Eastern District of North Carolina, and as Trial Counsel to the Commander, Ist Region ROTC Cadet Command and the Commanders of several separate combat or combat support units (including Dragon Brigade, 18th Aviation Brigade and the 16th Military Police Brigade). Prosecuted hundreds of criminal cases in federal courts and military courts-martial, tried 29 cases to verdict, and defeated two appeals to the Fourth Circuit Court of Appeals. Served as an Administrative Law Attorney advising the Fort Bragg garrison command and XVIII Airborne Corps staff. Deployed with JTF Andrew in support of Hurricane Andrew relief efforts. Released from Active Duty on September 29, 1995, upon completing required period of active service. Remained a member of the Individual Ready Reserve through August 28, 2000 (Honorable Discharge).
