I have represented clients in arbitrations under various arbitration rules, including the HKIAC Rules, ICC Rules, CIETAC Rules, Vienna Rules, ICDR Rules, and UNCITRAL Rules. I have been repeatedly appointed as arbitrator in arbitrations under the 1998, 2012 and 2021 ICC Rules (seats: Hong Kong, Shanghai), and under the HKIAC Rules (seat: Hong Kong).I, together with our International Arbitration Team in Hong Kong and the APAC Region, help clients through the lifecycle of transactions to minimize exposure to risk, avoid disputes whenever possible, and resolve them efficiently when they arise. My core practice encompasses:- Advising clients on the appropriate choice of governing law and dispute resolution mechanisms for their transactions. Advising on the proper drafting of arbitration clauses and other DR clauses (including multi-tiered clauses, mediation clauses, expert determination clauses) and waiver of immunity clauses.- Providing expert advice at every step of the arbitration process. Guiding clients through alternative dispute resolution processes, such as amicable negotiations and mediation, and helping them explore settlement options, advising them on financing options for their arbitrations (third party funding and outcome related fee structures) and helping them to enforce awards.- Acting in arbitration-related court proceedings in Hong Kong, such as proceedings for interim measures, including anti-suit injunctions, setting aside, enforcement and winding-up proceedings, and advising them on arbitration-related court proceedings conducted abroad.
