Pippin C. Brehler has served in the Legal Office of the California Air Resources Board since 2015, where he is currently an Assistant Chief Counsel. He has been one of the principal attorneys on the team developing and defending California's requirements to virtually eliminate air pollution from new cars and light trucks on the road. Besides his work on this groundbreaking program, he has coordinated multiple regulatory proposals through the administrative process and successfully defended them in litigation for the Air Resources Board and the California Energy Commission. This included drafting opinions on eminent domain and environmental law. In particular, assisted Justice Kelly in her consideration of Michigan's landmark eminent domain case, Wayne County v. Hathcock. This case, addressing the limits of the takings power under the Michigan Constitution, held that the power of eminent domain may not be used to simply transfer private property to a different private owner for a "better" private use. The Michigan Supreme Court reached the opposite conclusion in Hathcock as the widely-criticized U.S. Supreme Court case of Kelo v. City of New London, which upheld under the U.S. Constitution the power of condemnation to acquire and convey private property to another private entity as a public use or purpose.
