She has an experience of more than 30 years in Intellectual Property Rights and has headed the Delhi Office of Indian Patent Office.She actively takes part in litigation cases for various clientele. Also, she is a member of IPR dispute mediation cell and takes care of both contentious and non-contentious matters.Ms Prem Lata is retired High Ranked Officer of Intellectual Property Office of India. She has served in Patent and Trade Marks Offices for 32 years and has served at Mumbai, Ahmadabad and Delhi Offices. She mostly handled the litigation and enforcement portfolio which included briefing of the Panel Advocates, holding conferences with them and filing of counter replies in the court in respect of cases filed against orders of the Officers having delegated powers of Registrar at Lower court, High court and Supreme court. Her work as Head of Office has been appreciated by the Controller General of Patents, Designs and Trade Marks. She herself was hearing officer for more than 13 years and has heard all types of Trade Marks cases.She is BSc., LL. B, M.A. (Public Administration) and also has various trainings imparted during WIPO programs and has also participated and represented IP Office of India in WIPO programs and meetings.She can handle all contentious and non-contentious matter related to registration of trade marks, post registration obligations including transmission and assignment/licensing.

To act as Supervisory officer of Examiner of Trade Marks and Supervise perform all contentious and non contentious steps in registration as may be assigned and to attend to appeals from orders of various Registrars to Appellate Board/High courts/Supreme courts after getting the draft approvals from CGPDTM. To suggest, recommend procedural changes and discuss the draft of required amendments in the legislation and procedural rules. To examine the grievances and to suggest to mitigate the pendency at at various levels.To attend to show cause and opposition/rectification hearings and to issue speaking orders after hearing the same. To attend to matters where complaints as to falsification of trade marks is received and to give factual opinion on the matters forwarded by the police.

To supervise Examiners, adjudicate trademarks show cause matters, including opposition proceedings and rectification proceedings and to issue speaking orders. To attend to court cases - appeals, writs etc. in Intellectual Property Appellate Board, lower courts, High Court and Supreme court and give effect to or forward the same for implementation to concerned sections of trade marks registry. To prepare briefing for the Government Counsel and filing the statement on behalf of Registrar of Trade Marks/ counter affidavit and to interact with Law Ministry in relation to trade Mark matters.To attend to other miscellaneous administrative matters including exercise of financial powers within the budget allocation by O/o Controller General of Patents, Designs and Trade marks. To obtain and get consolidated the performance report of all officials designated as in-charge of different section.To attend to matters relating to opinion of Registrar of Trade Marks to the Police and also provide information to the other Government Department as are sought from this office.To attend to and to hear the contested Assignments and Licencing and to pass orders on merits.To attend to amendment and order and give effect to clerical errors pertaining to Trade Mark applications.I have dealt with checking of proper classification from the Jan, 1994. Saw various changes. Extension of classes, addition of Service classes, after new law in India came into force.

Examination of applications received for registration of trade marks under the provisions of Trade & Merchandise marks Act, 1958 and to issue the examination report under signatures. The examination included the scrutiny of application under affiliated acts and notifications with regard to prohibitions of certain marks to be registered. Making search in database and citing of the marks where deceptively similar marks are found in database. To scrutinize the classification of specification of goods/services, as per nice classification as adopted under Trade Mark Rules. To consider the replies filed to these matters and issue notice for show cause hearings and conduct hearings and issue order of refusal or acceptance or acceptance with conditions or subject to amendments. To give grounds of refusal for filing appeal in higher court. To scrutinize the notice of opposition, counter statement, evidence, reply evidence and issue notice of hearing where pleadings are complete.To scrutinize interlocutory petitions and applications. To scrutinize and allow amendments in trade mark applications.To hear review of the orders issued. To hear show cause where withdrawal of acceptance is recommended. To attend to court cases by briefing government counsel and filing replies. To give factual opinion for search and seizure to Police in cases pertaining to falsification of marks. To act as drawing and disbursing officer, to supervise the work of Establishment section,diary and dispatch section.

To assist legally the hearing officer throughout the opposition proceedings of Patents applications by examining the documents, preparing briefs, collecting references and making extracts thereof. Wherever appeals are filed in High Court from the decisions/orders issued by the Tribunals - to examine the documents and to get the counsel appointed through Ministry of Law ans Justice and help him through the proceedings and to appear in the court, if required. Compilation of orders/decisions issued by the Tribunals of all offices and to prepare notes thereof of important Law points in view of various legal provisions of the Act. To appear and assist where evidence from Patent office was required. To attend to administrative matters of the office in Central Administrative Tribunal as per directions of the office.To examine the documents and to carry out amendment and assignment proceedings as per the provisions of the Act.
