The Court held that an unlawful and unreasonable warrantless search of the client’s property was conducted by the Police and thus ruled that the improperly obtained evidence was inadmissible pursuant to s 30 of the Evidence Act 2006 resulting in the conviction being quashed. Cato v Manaia Media Limited & Ors [2022] NZHC 1727: Successful defence of an interlocutory application by the plaintiff as to the admissibility of expert evidence in a long-standing defamation case. The Court adopted a Privy Council (Bermuda) precedent in accepting that expert witnesses can rely exclusively on professional experience in proffering evidence and need not have an empirical or scientific basis. -

To note, I was a key member (alternate PMO) in a cross-border consultancy project within the technology, media, and telecommunications sector.This project involved a gap assessment study in relation to anti-bribery & corruption (ABAC) and other ethical compliance matters for a publicly-listed multinational telecommunications company. A comprehensive restructuring of the company’s ABAC framework was recommended, designed, and subsequently implemented in anticipation of the new s 17A amendment to the Malaysian Anti-Corruption Commission Act 2009 (statutory equivalent to s 7 of the UK Bribery Act 2010). I also worked on a comprehensive strategic review and fact-finding investigation in relation to material investments and transactions of an entity of the Malaysian Government. -
