Avoided all discovery and litigation costs on Mold BI case for family of 4 through early intervention, multi-carrier tender and indemnity time-on-risk share of $90,000. Reduced defense obligations to Insured by leveraging late-notice/prejudice provision, paying actually covered damages of $6,500 and actual post-tender defense costs at panel rates of $26,000 on $425,000 total demand. Reduced apparent settlement from $385,000 to a negotiated time-on-risk share of $135,000 by leveraging Plaintiff failure to mitigate and EIFS exclusions not identified by co-defendants.

Successful defense of Additional Insured claims through careful review for Type 1, 2 or 3 and Form 2009 or 2010 language, resulting in numerous denials of tenders and non-payments.
