Richard Salgado is the Head of Litigation for McDermott in Dallas. He has a nationwide practice focused on complex and challenging matters. He has obtained significant wins for clients in cases of all types, including class actions, antitrust, intellectual property and commercial litigation matters, in state and federal courts across the US. Many of Richard’s cases have been featured in Business Week, Bloomberg, The American Lawyer and Law360. As trial counsel, Richard has successfully litigated cases at the preliminary injunction, dismissal, mediation, class certification, summary judgment and trial stages. Substantively, he has represented clients in antitrust, False Claims Act, Racketeer Influenced and Corrupt Organizations Act (RICO), environmental toxic tort, land use, breach of contract, employment, products liability and intellectual property disputes. Most recently, he avoided class certification and obtained summary judgment on RICO claims on behalf of a major health care industry client. Richard also routinely assists clients with pre-litigation analysis and strategy involving novel or complex legal issues. As appellate counsel, Richard has obtained successful outcomes in the United States Supreme Court, each of the 13 federal circuits, and numerous state appellate courts. He has repeatedly had multimillion-dollar jury verdicts overturned and preserved major wins in post-trial proceedings, and he maintains a winning record in seeking writs of mandamus and other forms of extraordinary interlocutory relief in state and appellate courts nationwide.
