CurrentI counsel institutional investors, private equity funds, domestic and foreign banking institutions, national mortgage lenders, consumer finance companies, Fintech companies, servicers, and other financial services companies on all aspects of federal and state consumer credit regulation. I also represent marketplace participants of non-consumer assets including, but not limited to, commercial real estate.At the federal level, my practice has focused on the changes to the consumer credit landscape brought about by Title X of the Dodd–Frank Wall Street Reform and Consumer Protection Act of 2010, which created the Consumer Financial Protection Bureau (CFPB). Notably, I haves technical knowledge of the alphabet soup of laws and implementing regulations within the purview of the CFPB, including TILA, RESPA, ECOA, HMDA, and the FDCPA, as well as regulations issued by agencies such as the Department of Housing and Urban Development/Federal Housing Administration (HUD/FHA), Fannie Mae, Freddie Mac, Ginnie Mae and the Department of Veterans Affairs. I also have experience addressing issues related to privacy and consumer reporting matters under the Gramm-Leach-Bliley Act and the Fair Credit Reporting Act. My focus at the state level includes licensing statutes, anti-predatory lending laws, “doing business” qualification statutes, usury limitations, prepayment penalty restrictions, and other state statutes that substantively govern consumer, residential, and commercial lending products. I have extensive knowledge of licensing requirements for, and financing of, hybrid residential-commercial real property transactions (e.g., “fix-flip” properties).Furthermore, I assist with transactions that necessitate diligence of substantive regulatory and/or licensing obligations, including securitizations and other secondary market transactions.
