As a member of Dinsmore's Work Place Safety Group my practice is focused exclusively on representing mine operators in the coal and metal/non-metal sectors of the mining industry. During my tenure with Dinsmore I have been responsible for overseeing litigation in over 1400 cases before the Federal Mine Safety and Health Review Commission and the West Virginia state regulatory enforcement agency. Prior to joining Dinsmore, I worked for nearly a decade as a full time underground coal miner. Between 1997 and 2004, I served as a Presidential appointee, twice confirmed by the United States Senate, as a member of the Federal Mine Safety and Health Review Commission. I also served as the Administrator of Legal Services for the West Virginia Office of Miners’ Health, Safety and Training.In addition to litigation, I routinely provide comprehensive pre-enforcement awareness training for management agents who frequently encounter MSHA inspectors in the work place. The training covers the Mine Act, MSHA regulations, and other MSHA related matters impacting mine operators on a daily basis. Finally, I also represent mine operators in myriad investigations conducted by MSHA stemming from accidents and the issuance of elevated enforcement actions.
