  My practice has included antitrust, contract, civil rights, class action, employment, trade practices, and franchise cases; particularly including claims under the federal Racketeer Influenced and Corrupt Organizations (“RICO”) statute. As part of those cases, I have used e-discovery tools and techniques in litigation for more than 30 years.For about 15 years I also have worked with our Corporate attorneys to counsel clients in records retention and compliance practices, with a proactive eye to both litigation and regulatory readiness. From concerns for (HIPAA) Protected Health Information in litigation, compliance work encompasses secure handling and disposal of non-public business and consumer data in a wide variety of circumstances. I have handled data security incident/breach response matters for clients for more than 10 years, including potential compromise of both personal and proprietary business information. In 2008 I co-founded and since 2014 I have supervised attorneys within the Firm’s electronic discovery and records compliance group. Our Group has focused on analysis and use of material information in transactions and legal proceedings. All of our Group attorneys are veteran practitioners with trial, appellate or arbitration successes to their credit. The Group has assisted more than 350 client-matters, including civil rights and product liability class actions; regulatory proceedings; M&A due diligence; records compliance programs; analysis of complex contracts for material terms or omissions; and white-collar criminal proceedings. We have worked with a wide variety of forensic experts and data processing/hosting providers. We also use electronic tools directly for iterative search, sampling or analysis of information. In particular, we emphasize our ability to analyze data in its native format as early and systematically as possible, to see and assess material information as the original user could have done.
