Mr. Johnston's practice focuses on trials and appeals of complex litigation matters, with an emphasis on defending pharmaceutical product liability litigation and on prosecuting insurance coverage disputes for corporate clients in many different industries. He has tried several pharmaceutical product liability cases to verdict, including Hogan v. Novartis Pharmaceutical Corporation, which resulted in a defense verdict for our client. Mr. Johnston manages the defense of serial litigations, including large multidistrict litigations, and represents clients in significant individual matters as well.Mr. Johnston has developed key liability defenses to sweeping allegations of corporate misconduct, and he has worked with experts and senior company employees to advance those defenses at trial. He has successfully defended class action claims and presently handles the nationwide defense of matters coordinated in two substantial multidistrict litigations.He represents clients in both state and federal courts in actions seeking coverage for environmental liabilities, asbestos-related claims, defamation, errors and omissions by insurance agents, and various other business torts. He also consults with clients regarding the pursuit of insurance proceeds under solvent and insolvent schemes of arrangement. He has written and spoken on numerous issues relevant to insurance coverage, including issues of fidelity insurance and coverages available for e-commerce enterprises.Mr. Johnston also has pursued litigation in connection with government contracts, including Winstar-related claims, nuclear-spent-fuel claims, and claims for the taking of property by the government without just compensation.
