I report to the NuScale President & CEO, lead a team of attorneys and paralegals and oversee the use of outside counsel at NuScale. Key participant in private strategic fundraising; in raising funds through U.S. Department of Energy funding; and in raising interest in private investment in public equity in support of taking the company public via a SPAC merger.

Effective April 20, 2015, I assumed the role of General Counsel & Secretary at Toshiba America Energy Systems Corp. (TAES) based in Charlotte, NC, reporting to the TAES President & CEO. In this position I served as a member of the TAES executive leadership team and will provide strategic and tactical advice on legal, business, regulatory, governance and compliance matters. I also served as general counsel and secretary for Toshiba America Nuclear Energy (TANE). I led the TAES legal team, had the TAES quality and safety teams reporting to me, and was responsible for coordinating TAES and TANE work with outside counsel.

I act as general counsel for Babcock & Wilcox' commercial nuclear energy business, which offers a variety of services and equipment for existing nuclear power plants and is developing the mPower reactor, the leading small modular reactor under development in the US. I also serve as the Generation mPower LLC General Counsel and Board Secretary. This venture, also funded by a subsidiary of the Bechtel Corporation, is the customer face for the mPower Plant, in its standard configuration a two-180 MWe unit, small modular reactor powered electric generating plant. In my spare time I am leading the mPower China development project and working with the team that secured DOE SMR funding.

Represented and served as a manager for the country’s largest municipally-owned electric and gas utility. I addressed issues before administrative agencies and negotiated significant commercial contracts, including the first purchase by a municipal utility of an interest in an operating commercial nuclear power plant and the engineering, procurement and construction contract for a nuclear power plant, and worked on US Department of Energy Loan Guarantees along with Japanese-sourced financing alternatives for construction of new nuclear power plants in Texas. Developed alternative financing strategies from domestic and Japanese sources. Served as Board Secretary through significant senior management and Board transitions.

Performed contractor support at Los Alamos National Laboratory, representing clients in commercial litigation and NRC hearings, reviewing NRC submittals, and negotiating commercial contracts for power plant components and nuclear fuel. Also represented clients in “superfund” litigation, successfully obtaining dismissal on grounds of de minimus liability.
