Het begeleiden van een mediation traject tussen Liander en Vattenfall over het tot op heden on shore grootste windturbinepark van Nederland te Wieringermeer, het Prinses Ariane Windpark. Verschil in inzicht over de contractuele afspraken alsmede aanzienlijke kostenoverschrijdingen door onvoorziene omstandigheden deden partijen besluiten deze discussies vroegtijdig te scheiden van de uitvoering, wat heeft geleid tot de tijdige oplevering van het park. Tijdens het daardoor ontstane langdurige maar constructieve mediation traject onder leiding van een gerenommeerde en zeer ervaren mediator, was ik verantwoordelijk (namens Liander) als contract- en claim manager voor alle benodigde rapportages, onderbouwingen en motivaties. Het traject is op een arbitrage-achtige wijze uitgevoerd en heeft voor alle betrokken partijen tot een bevredigend resultaat geleid. In mijn lange ervaring met dergelijke disputen is dit een schoolvoorbeeld hoe partijen op een nette wijze ook tot een oplossing kunnen komen!

Haps (Cuyck)

Contract en Claim Manager voor Actemium (Vinci groep) waar ik namens Actemium werkte op een utilitieitscontract voor Nutricia / Danone (food industrie) voor de bouw van een nieuwe babypoeder fabriek in Haps. Het Actemium contract (onder UAV 2012) bestond uit een bouwcombinatie van drie Actemium entiteiten: Cegelec (Elektrische installaties), Cegelec Fire Solutions (sprinkler installaties) en Vinci (o.a. BMI en andere controle systemen).

Starneth Holding is a specialized engineering and management company in Design and Built of gigantic ferris wheels. Starneth, or its founders or employees, were or are prominently involved in the largest ferris wheels on earth such as the Londen Eye, The Ain Dubai (in progress, planned to be finished 2019) and the New York Wheel (currently on hold). My core activities was managing of the main contracts in place, Dubai Wheel and New York wheel with the clients and partners (Hyundai for Dubai and Mammoet for New York Wheel). But also managing of the engineering contracts (on both contracts KCI), subcontracts on construction. Further, as a management team member of Starneth BV, I was involved in all contracts and tenders Starneth world-wide, which was mainly focused on development of new leisure. Due to the high potential in Europe, I was appointed in 2015 as managing director for Starneth European Projects B.V, which has it’s main purpose on project development for new leisure projects which included a Ferris wheel or any other height attractions, combined with real estate, particularly for Europe. New designs were developed, amongst others with UN Studio from Amsterdam, which are still being developed by me in cooperation with the Starneth founders.

The Firm IPCM was a consultancy agency on managing contracts and preventing and solving disputes. The bureau was specialized to provide consultants for many different cases which required specialised skills in strategic contracts management, trouble shooting and claims preparation (including court handling). Main activities at IPCM were, besides my function as Operational Manager and member of the Management team (refer for a selection of specific jobs to my other experiences listed):Contract manager, Claim building and case studies (mostly successful) for many large companies, Contracting, trouble-shooter and management advisor (recovery management), as well as support on further proceedings (civil/utilities new build, general construction projects, petrochemical-& process industry). Clients were amongst others BAM LNI, GTI, Vos-groep, CFE/GEKA Nederland, Mourik, Shell, The Dutch Gas Unie, Stork, Hertel, van Wijnen, Imtech, Spie and GTI.Dispute resolution (successful) conform the “ADR’ concept for several international Contractors (civil, utilities and process) such as on cases for BAM, GTI, Vopak/ Vos-groep, CFE/GEKA

Mercon Steel Structures is a medium size Steel Fabricator now, however in the period that I worked there it was besides one of the best steel fabricators also one of Hollands best engineering management and management organization on handling complex EPCI contracts.I started my career as planning engineer, but developed soon to Contracts manager and ultimately Senior Project manager. My specialism was strategic contract management by managing multidiscipline EPCI turn-key projects -up to lump sum €120.000.000 -involving (detail) engineering, shop-engineering, procurement, fabrication, on (and sometimes off-) shore hook-up & commissioning. Focus for the project manager is strong contract management both to client and subcontractors, because these projects are always under extreme time pressure and low budgets.
