I have been employed with the Small Enterprise Finance Agency SOC Limited (“sefa”) (previously known as Khula Enterprise Finance Limited (“Khula”)), a wholly owned subsidiary of the Industrial Development Corporation (IDC) and of which the ultimate shareholder is the Department of Economic Development (EDD) of the National Government of South Africa since March 2009.I report to the Chief Executive Officer, am a standing invitee to the Credit Committee, Management Committee, Executive Committee and Enterprise Risk Committee of the Board of Directors and report to said committees on all legal matters. I am responsible for the divisional business plan, balanced scorecard, strategy and budget of the legal services division (which is done in line with sefa’s vision, mission and strategy and its mandate from National Government). My position, in short, furthermore entails the following:1. Annually develop legal policies based. Identify gaps and risks, advise thereon and develop new or amended policies when needed2. Draft, vet, advise and negotiate agreements on behalf of the company, Review existing agreements, identify gaps and risks. Ensure all agreements to be in line with applicable legislation and regulations3. Draft and distribute standard templates for Wholesale and Direct Lending facilities4. Provide legal opinions and advice as required on all legal issues5. Provide induction and compliance training – FAIS and FICA6. Legal budget – manage, review. Identify and report on variances monthly. Centralised company wide budget 7. Recruitment and selection of employees, manage employees – performance, individual development8. Assist the company with dispute resolution, including Industrial Relations matters - in person when allowed at law 9. Manage external service providers of legal professional services in case of litigation10.Attend to all other related legal matters
