We identify deficiencies in current practices and develop appropriate program modifications to prevent and/or discover illegal, unethical, or improper conduct. Tunlaw’s review process and recommendations are structured around the U.S. Sentencing Guidelines for Organizations and the Committee of Sponsoring Organizations of the Treadway Commission (COSO). Assessments are conducted to evaluate existing compliance structure, to identify opportunities, and to make recommendations for improvements. Then, internal controls, ethics, and compliance training programs are designed and delivered to ensure effective collaboration and communication with key stakeholders. We also serve as an Independent Monitor for Federal Administrative Compliance Agreements (ACA) used to settle the terms of a suspension, proposed debarment, Non-Prosecution and Deferred Prosecution Agreements.

Held total authority for the ICE S&D program. Gained consensus for program development from senior DHS leaders including the Director for ICE and the Secretary of DHS. Conducted a comprehensive program risk assessment which considered risk exposure, technology, and legal challenges - then developed and implemented appropriate recommendations. Prioritized and allocated resources to ensure success. Partnered with key stakeholders. Integrated policies and procedures into organizational structures, established proper checks and balances, developed a supporting IT system, developed and delivered training, and built support functions within DHS. Instructed is the area of Federal suspension and debarment at FLETC and for the Council of the Inspectors General on Integrity and Efficiency (CIGIE). The U.S. Government Accountability Office (GAO-12-245T in 2011) found that ICE was one of the four best federal agencies for suspension and debarment activity and that they were based on federal grants and assistance regulations (NCR).

Worked on multiple high-profile/high-dollar Information Technology (IT) hardware and software acquisitions; served as Division Assistant Director. Collaborated with ICE IT to identify, evaluate, and mitigate data security exposure to protect information. Ensured ICE contracting policies and procedures were followed. Remained vigilant relative to possible contractor fraud and developed/implemented plans for mitigating procurement risks. Discovered multiple cases of contractor fraud.

Managed complex, high-dollar contracts and subcontracts for Federal Emergency Management Agency (FEMA) reconstruction of Mississippi after Hurricane Katrina - from initial planning through execution and completion. Ensured established contracting policies and procedures were followed. Discovered substantial subcontractor fraud. Protected U.S. confidential and proprietary information. Prepared and released formal contract documents for cradle-to-grave contract management. Oversaw transport and setup of 35,000+ FEMA trailers in four months, as well as the construction of numerous trailer camps and relevant infrastructures in a highly challenging, post-tragedy environment.

Volunteered and deployed with Defense Contract Management Agency (DCMA) to Iraq in 2003 during Operation Iraqi Freedom/Noble Eagle for both the $36 billion LOGCAP III and the $10 billion AFCAP contracts. Supervised the purchase of more than $8 billion in infrastructure, logistics, ammo, fuel, food, and other products in six months covering 18 major installations around Baghdad, Iraq. Insured adherence to FAR and DFARS policies and procedures. Used Firm Fixed Price; Cost; Time and Material; Award Fee; and Multiple Award Contracts. Held TS/SCI Clearance.

Established a U.S. Federal contracts department of 18 employees which managed 17 large-scale, US-funded logistics contracts valued at more than $30 billion annually. Contract types included: Cost; CPFF; CPAF; FFP; and IDIQ. Established contracting and government property policies and procedures. Conducted contract negotiation, pre/post award risk-analysis, contract administration, claims management, and customer service activities to provide for proper contract acquisition and fulfillment in accordance with FAR and Defense Federal Acquisition Regulation Supplement (DFARS) requirements.
