Myself and my team provide a bespoke consultancy service for various law firms who deal with Proceeds of Crime matters and assisting them within the Proceeds of Crime Act (POCA) proceedings.The areas of POCA that I specialise in are as follows;1) Pre- Order Confiscation matters2) Section 22 and 23 POCA applications3) Applications to extend time to pay pursuant to Section 11 of POCA4) Enforcement and Post Order5) Variations and Restraint Orders6) Applications to Discharge Restraint Order pursuant to Section 42 of POCA7) AppealsNotable cases are as follows;R v M - Alleged benefit figure of £63,000, following a contested confiscation hearing and successful legal submissions a nominal order of £1 was made.R v N - Following a contested confiscation hearing a nominal order of £1 was made.R v K (Court of Appeal) - Following legal submissions the defendant’s sentence was successfully reduced from 6.5 years to 5.R v N - Following legal submissions and negotiations the benefit figure was reduced from £1.5 million to £900,000 and an available amount of £100,000 was agreed which represented monies already held by the authorities. No term in default was served.R v K - Large MTIC fraud case, following a contested hearing the benefit figure was reduced from £30 million to £7 million with an available amount of £2 million ordered to be paid.R v I - Mortgage Fraud case, following a concisely drafted s.18 statement the Crown identified the defendant had not realisable assets and made a nominal order of £1.00.R v P - Large money laundering case, following legal submissions and negotiations the Crown reduced the benefit figure substantially to £15,346.15, halved the available amount to £1,500.00 which represented funds held in the defendants bank accounts.
