I successfully obtained a favorable appellant decision of first impression that established what could be considered a deceptive act under Indiana's consumer protection statute in the case of Gasbi, LLC v. Sanders, 120 N.E.3d 614 (Ind. Ct. App. 2019). Gasbi was a groundbreaking decision in the area of consumer protection and enforcement litigation. The court held that a violation of a regulatory-type statute may trigger liability under Indiana's consumer protection statute. This ruling expanded the scope of Indiana's consumer protection statute by allowing it to be applied to cases that would have been excluded previously. The novel legal theory has helped consumers recover millions of dollars, and the count is still ongoing.
