I am a Senior Legal and Commercial Counsel with 15+ years’ of experience specifically in the telecommunications and mining industries. I provide counsel with the key focus being the reduction and management of risk, resolving complex and significant commercial and legal issues and enabling my employer to achieve its goals. I have gained extensive experience within the:A. Consumer Sales Function (FMCG) from both a legal and commercial perspective. I was lead senior commercial legal counsel responsible for the commercial legal support for consumer sales and distribution business in South Africa. I led a team of three commercial legal advisors. While at MTN Proprietary Limited (“MTN”) My work primarily related to the negotiation, drafting and implementation of a variety of high value and complex commercial agreements, with domestic and international clients/partners; and B. Supply Chain Function of the mining industry from both a legal and commercial perspective (locally and internationally). I was and am currently lead counsel in relation to negotiation, drafting, implementation and the provision of commercial legal advice in relation to a variety of high value commercial agreements with local and international suppliers and service providers. While at AngloGold Ashanti Limited (“AGA”), the majority of my work was in Africa within jurisdictions such as: South Africa, Ghana, Guinea, Tanzania and Mali with occasional matters in Brazil, Columbia, Argentina and Australia. The most notable commercial agreements being large-scale and high value supply and services agreements such as:i. Mining Services Agreements for various mining operations in the Africa (e.g., AGA’s Siguiri Gold Mine in Guinea and its Obuasi Gold Mine in Ghana; andii. EPC Agreement for onsite captive power generation for various operations in Africa (e.g., AGA’s Geita Gold Mine in Tanzania and the Siguiri Gold Mine in Guinea). My current position is Legal and Commercial Manager within the Thungela Resources Limited (“TRL”) focusing on the Supply Chain, Marketing/Sales and the Business Development Departments. My principal duties include commercial and legal support in relation to:1. operations management of the legal function across the TRL Group, specifically within Supply Chain; 2. the Business Development Department, specifically in relation to mergers and acquisitions; and 3. Marketing, specifically in relation to high value Coal Supply / Offtake Agreements and Logistics / Transport Agreements (specifically freight rail and road).
