I managed Newegg's litigation practice with supervisory oversight of the HR function. This consisted primarily of business litigation, intellectual property (patent), Human Resources / employment, insurance, and unfair competition issues.Highlights:I. ** Soverain Software v. Newegg, Inc. (aka the "Online Shopping Cart case") **: Part of the appellate team before the the U.S. Court of Appeals, Federal Circuit, which resulted in: (1) a unanimous ruling invalidating all patents that Soverain had asserted against Newegg (and a host of other e-retailers), and (2) a reversal that completely overturned the initial $2.5 million trial victory Soverain obtained from a jury in the Eastern District of Texas in 2010. This victory also calls into question Soverain's ability to collect over $18 million in judgments it won previously asserting the same patents against Avon and Victoria's Secret. Overstock.com, Inc. and Newegg, Inc. **: Part of the October 2011 trial team in the Eastern District of Texas, which resulted in: (1) a complete defense verdict (negating over $12 million in claimed damages), with express findings of non-infringement by the jury, and (2) the invalidation of Alcatel's '131 patent which allegedly covered basic e-commerce functionalities.
