About Scott Mueller
I love real property law. I have practiced continually in real estate, commercial and financial litigation since 2006. I also served as in-house counsel at one of the world's largest lenders as well as a regional commercial bank. I was honored to serve as an Assistant Adjunct Professor of Law at Saint Louis University School of Law in 2022/23, teaching Real Estate Transactions.I try cases, argue dispositive motions and appellate matters nationwide and some of the 7 reported decisions “made law” in MO, KS & IL. Since 2009, I have managed practice groups resolving high-volume and high-exposure title insurance, real estate lending and contract disputes nationwide.We leverage the collective curative strategies, methods, contacts and resources that have been compiled, organized and indexed throughout the decades of real property litigation experience with thousands of claims. These tools allow for an efficient and economical time to cure and a competitive advantage with systematic updating, cost monitoring and risk assessment at every step.My litigation practice addresses threats to collateral and ownership interests stemming from lien validity and priority; mechanic's liens and tax sales; fraud and misfeasance in the mortgage underwriting and closing process; defective documentation; bankruptcy, probate and condemnation procedures; title claims, coverage and vexatious refusal; and a wide array of contract and commercial litigation themes.My practice regularly resolves (many thousands of) real estate and mortgage problems on behalf of lenders, mortgage servicers, owners, developers, title insurance underwriters and title agents.The Journal of the Missouri Bar, The Appraisal Journal and the ABA published my various articles and I presented over 20 CLE presentations. Missouri Lawyers Media recognized my work in one of Missouri's largest defense verdicts, and I hold an "AV Preeminent" rating from Martindale-Hubbell. I was named to the 2019 & 2020 "40 & Under Hot List" by Benchmark Litigation.In 2015, the Supreme Court of Washington adopted my definition of equitable subrogation as set forth in the August 2010 Journal of the Missouri Bar.I volunteered in the St. Louis County Older Residents Program, assisting indigent St. Louis County residents with estate planning. I became a commissioner in the Webster Groves Plan Commission in 2014. I also served as Chair of the ABA's Title Insurance Litigation Committee and currently serve as SIUC COLA Alumni Advisory Board.

CurrentI love property law and dedicated nearly 20 years of my practice to real estate, title insurance and related legal disputes. But I felt like my experience as a litigator lacked crucial context at arm’s length from my clients’ perspective: “on the outside looking in” as a trial attorney hired only after a problem arose. So, I went "through the looking glass" and spent the last two years learning more than ever as in-house counsel to one of the world’s largest lenders. I even had the opportunity to teach real estate transactions as an adjunct at my alma mater and concluded my term-capped service for the Webster Groves City Plan Commission and began a small solo law office. But I missed my practice, the courtroom and, most importantly, my clients so ultimately in-house counsel wasn’t for me. I couldn’t be happier to return to the practice, this time with much more appreciation and understanding of real estate transactions, mortgage lending, underwriting, national trends and eccentricities, and servicing. I have known some attorneys at Capes Sokol, so when the opportunity presented itself to join a great law firm and return to a more substantive, hand-on experience, I jumped for it. I would love to help you with just about any property matter, from title insurance to closings to zoning to disputes or negotiations. I can assist with litigation or curative work and I always strive for efficiency and excellent results – even if creatively arranged.
