I love property law and dedicated nearly 20 years of my practice to real estate, title insurance and related legal disputes. But I felt like my experience as a litigator lacked crucial context at arm’s length from my clients’ perspective: “on the outside looking in” as a trial attorney hired only after a problem arose. So, I went "through the looking glass" and spent the last two years learning more than ever as in-house counsel to one of the world’s largest lenders. I even had the opportunity to teach real estate transactions as an adjunct at my alma mater and concluded my term-capped service for the Webster Groves City Plan Commission and began a small solo law office. But I missed my practice, the courtroom and, most importantly, my clients so ultimately in-house counsel wasn’t for me. I couldn’t be happier to return to the practice, this time with much more appreciation and understanding of real estate transactions, mortgage lending, underwriting, national trends and eccentricities, and servicing. I have known some attorneys at Capes Sokol, so when the opportunity presented itself to join a great law firm and return to a more substantive, hand-on experience, I jumped for it. I would love to help you with just about any property matter, from title insurance to closings to zoning to disputes or negotiations. I can assist with litigation or curative work and I always strive for efficiency and excellent results – even if creatively arranged.

Real Estate Litigation Representative Experience:Over the course of thousands of matters, Scott's practice resolved commercial and real estate disputes across the Midwest and Southeast (where his previous firm primarily operated), including:• Prioritizing clients' compromised security interests to senior positions against competing lenders, the IRS and other lien holding entities.• Invalidate mechanic's liens, judgment liens, conflicting ownership interests and claims by advancing and expounding upon equitable principles of subrogation, replacement theory, judicial estoppel and other equitable remedies and arguments.• Reported Cases: Tetrault v. Developed and led Title Litigation practice group consisting of attorneys and paralegal which resolved hundreds of issues affecting clients' interests in real property and secured loans in Kansas, Missouri and Illinois. Created case strategy methods and argument points for efficiently resolving litigation across spectrum of real property title defects.

My practice revolves around the lending relationship and, more specifically, commercial and real estate litigation. I have also assisted clients with corporate structure, transaction, financing and development needs.
