My practice focuses on environmental and energy matters. I represent corporations (including utilities, independent power producers, and oil production and refining companies) and numerous local government special purpose authority clients. This work brings me before federal and state administrative agencies as well as state and federal trial and appellate courts. I also devote a significant part of my practice to legislative matters, in particular the U.S. Congress with a focus on renewable energy. My practice encompasses a broad range of air quality matters including New Source Review permitting, New Source Performance Standards and Emission Guidelines for existing stationary sources. In addition, I regularly assist clients with a diverse cross section of surface water regulatory and litigation matters including NPDES (National Pollutant Discharge Elimination System) permit matters, USEPA rulemaking, and citizen suit defense matters. My practice also includes groundwater protection and regulatory matters under the Safe Drinking Water Act. Much of my practice addresses Superfund (Comprehensive Environmental Response, Compensation, and Liability Act − CERCLA) remedial disputes in USEPA Regions 2-5. An increasing focus of my work for local governments involves development and licensing of waste-to-energy matters, as well as counseling local governments regarding their use of “flow control” authority for management of municipal solid waste.
