Experience at Carr McClellan includes:• Co-tried high-stakes AAA arbitration concerning damages arising from breach of software license agreements in telecom industry. (Assumed representation after client’s breach was established.) Successfully limited claimant’s recovery to less than 4% of its 8-figure demand.• Lead trial counsel before JAMS defending professional negligence action arising from case involving business fraud and embezzlement. Achieved complete defense ruling on all of plaintiff’s claims.• Assistant trial counsel representing government agency in two-month trial (including two-week jury phase) regarding breach of lease. Jury found for client on all issues. Case was part of complex, interconnected series of lawsuits and bankruptcy filings, including an $840 million claim.• Defended major building services provider in multi-million dollar trade secret lawsuit regarding alleged theft of customer lists and business leads, resulting in a favorable settlement before trial.• Represented fabless semiconductor firm regarding suspected trade secret misappropriation by foundry subsidiary; successfully negotiated favorable resolution without needing to file suit.• Defended technology company from wrongful termination whistle-blower and gender discrimination claims. The matter settled favorably before trial.• Represented hotel in trademark and trade name infringement action and secured permanent injunction against offender.• Represented tax preparation business in federal trade secret and trademark infringement lawsuit. Secured return of trade secret information and all rights to disputed trademark through settlement before trial.
