Assistant General Counsel and Supervisory Attorney in the Office of the General Counsel’s Bankruptcy, Litigation, and Transactions Division. Duties include representing PBGC in federal and state courts in litigation relating to the agency’s ERISA statutory functions including: plan termination actions; plan termination liability collection actions; plan sponsor or controlled group member bankruptcy, insolvency, receivership, or probate proceedings; and standard termination compliance proceedings. I supervise a team of six attorneys engaged in the same duties and responsibilities.Duties also include serving as legal advisor and counselor on: PBGC’s initiation of litigation and investigative proceedings; involuntary plan terminations; distress plan terminations; termination liability collection and settlement; and standard terminations. Litigation practice included: representing landowner in commercial agricultural litigation; representing dental practice member in litigation and arbitration proceedings with other member; defending business and principal in ERISA delinquent contribution litigation; defending employer in federal tax litigation; representing parties in commercial breach of contract actions; representing plaintiff in wrongful termination, defamation and constitutional/due process violation litigation; and representing parties in divorce actions.Counseling practice included: advising employers on wage and hour issues; advising employers on unemployment compensation issues; advising employers on handbooks and workplace policies (including social media policies), confidentiality agreements, and severance agreements; representing employers in gender discrimination, race discrimination, and retaliation claims before the EEOC and state administrative agencies; advising employees on termination and separation issues, including severance agreements; and advising employees on medical leave issues.

Litigation practice included: representation of plan sponsors, fiduciaries, and service providers in ERISA Title I litigation (breach of fiduciary duty actions, denial-of-benefits actions, retiree health/medical benefit actions, and benefit discrimination actions); representation of employers in litigation (federal Title VII, federal Section 1981, and related state law employment discrimination claims; wrongful termination claims; federal and state wage and hour claims; and federal contractor compliance matters).Counseling practice included: ERISA counseling (Title I pension and welfare plan administration and fiduciary matters, QDROs, and COBRA and subrogation issues for welfare plans); and employment counseling (issues under the ADEA, ADA, Title VII, FMLA, FLSA, Sections 1981 and 1983, HIPAA, USERRA, the Maryland Wage and Hour Law, and the Maryland Wage, Payment, and Collection Law; severance agreements, termination agreements, and employee policies and handbooks (including evolving NLRB guidance on social media policies); gender discrimination, race discrimination, and retaliation claims before the EEOC and state administrative agencies; and workforce reductions and terminations).
