Key Results:• Represented Chapter 7 Trustee in litigation to deny debtor’s discharge. Stipulation Denying Discharge was obtained on the eve of trial. Creditors may pursue the debtor for $550,000.• Successfully defended debtor client from an action to deny his discharge of $22M in debts. Was primarily responsible for all legal research and discovery, acted as co-counsel in the six-day trial.• Litigated Proof of Claim on behalf of Trustee. Reduced claim from $400,000 to $2,000.• Recovered $15,000 in fraudulently transferred funds without resorting to litigation. Responsibilities: • Managed the debtor representation program and coordinated the drafting and filing of all Chapter 7 and Chapter 13 bankruptcy petitions for individual and corporate clients.• Advised clients with respect to financial workouts, bankruptcy, state court receiverships, Small Business Administration (SBA) Offers in Compromise, tax debts, and collections litigation. • Represented Chapter 7 Bankruptcy Trustees in asset recovery matters and various litigation. • Performed financial and strategic analysis to develop settlement recommendations. • Researched legal issues and drafted correspondence, pleadings, motions, and memoranda. • Created and responded to discovery requests including interrogatories, requests for production of documents, and admissions.
