CurrentMy practice focuses on business litigation/advice and employment law.I devote a substantial portion of my practice to representing companies in complex business disputes in federal/state courts and arbitration across the country. My cases have involved commercial contracts, real estate, civil RICO, common law fraud, False Claims Act, fiduciary duties, business owner breakups, bank loans, consumer protection claims, Fair Housing Act, Equal Credit Opportunity Act, insurance coverage, enforcement of arbitration provisions, representations and warranties, defamation, privacy rights, HOA issues, constitutional issues, and construction claims, among other matters.I also regularly advise companies on employment policies, procedures, and practices. I have defended companies against claims involving Title VII, ADEA, ADA, FMLA, SOX, FLSA, NDAA, IRCA, similar federal/state statutes, and various torts. I have appeared before the EEOC, DOL, DOJ, and state/local agencies; plus I have litigated employment claims in federal/state courts and arbitration in multiple jurisdictions. I regularly work with companies implementing trade secret protection programs, including the strategic use of noncompete/nonsolicitation/nondisclosure agreements, as well as other provisions designed to protect a company’s intellectual property and other interests. I have litigated numerous unfair competition cases of significant value involving trade secrets, restrictive covenants, and related tort claims. I have successfully “reverse engineered” my litigation experience to become an effective advisor trying to avoid litigation and negotiating various business contracts, such as subcontracts and vendor, lease, sales, service, and teaming agreements. I also have been retained as a legal advisor and an independent investigator to conduct highly sensitive and complex investigations concerning various allegations of misconduct.I am based in Annapolis and work out of our Virginia office at times.
