STEVE MALIN is a seasoned litigator in the area of patents and other intellectual property rights. His thirty years of experience include all aspects of pretrial and trial proceedings in patent, IP, and high stakes commercial litigation. He has tried a score of cases in state and federal court, most as first chair counsel, and has been attorney of record in over 50 patent lawsuits. Mr. Malin's cases include a patent jury trial in 2012 on behalf of a defendant manufacturer of optical fiber equipment (verdict - noninfringement), a jury trial in 2010 where he recovered the domain name of the world's largest publicly funded museum from a hard charging offshore internet holding company (the case settling after Mr. Malin's cross examination of the opposing party's corporate representative), and a jury trial in 2008 where Mr. Malin recovered a seven figure settlement on behalf of minority shareholders in a corporate dispute (the case settling after Mr. Malin's presentation of opening statement). Not limited to actions in traditional courts, Mr. Malin prevailed in 2011 at an ITC Section 337 hearing obtaining a noninfringement finding on behalf of an Asian semiconductor manufacturer. The ALJ's ruling of noninfringement was affirmed by the ITC in 2012. In 2020 Mr. Malin's client, a major Chinese game developer, was faced with issuance of a crippling TRO entered before Mr. Malin entered the case. On the morning of the preliminary injunction hearing, Mr. Malin argued two motions seeking to have the entire case dismissed due to improper forum choice. Both motions were granted and Mr. Malin's client secured a complete victory.
