Practice areas include commercial and construction law, procurement, real estate, bankruptcy, corporate compliance, insurance, intellectual property, litigation and alternative dispute resolution. • Structured and negotiated favorable settlements of complex, multi-party disputes involving subway, railroad and bus operations, saving MTA/NYCTA an estimated $35 million in potential claims. • Successfully defeated over $17 million in claims against MTA/NYCTA in federal and state court litigation and ADR proceedings involving contracts for installation of VHF radio networks, connection-oriented Ethernet systems, CCTV security systems, Automatic Train Supervision systems, SONET systems, ADA-compliant elevators and bus depots. • Led negotiations and coordinated efforts of three agency departments and two vendors in successful emergency assignment of $28 million multi-agency uniform supply contract after original vendor's default. • Advised in drafting of advantageous risk allocation provisions in master terms and conditions of NYCTA's capital construction contracts. • Impelled agency-wide procurement policy requiring stronger vendor background checks, reducing vulnerability to bid protests and potential for troubled projects. • Strengthened alliance between law department and agency managers through training and mentoring, resulting in earlier resolution of disputes and substantial reduction in claims filed. • Extensive experience drafting, interpreting and advising on construction contract terms and conditions, change orders, modifications and assignment agreements.
