I am a partner in the Baltimore Office of Dehay & Elliston. I regularly lecture and present around the United States on regulations, remediation and litigation associated with Legionella amplifications and outbreaks of Legionnaires' disease. With more than four decades of experience I have successfully defended complex and high-profile civil and criminal cases in the state and federal courts throughout Maryland and Washington, D.C., and in other parts of the country. I regularly lecture around the I focus my practice on the defense of toxic tort actions against companies in a wide range of industries, with particular concentration on defending claims alleging exposure to Legionella bacteria (i.e., Legionnaires' disease), asbestos, lead paint, carbon monoxide, and mold. I also has extensive experience defending personal injury, premises liability, and product liability. I have litigated hundreds of serious criminal cases over the past 30-plus years, including two capital cases. I have also authored of Defending Allegations of Sexual Child Abuse in Maryland, an original treatise published in 2004 that highlights a sub-specialty of his criminal practice and is used by the District Court of Maryland in the training of District Court Commissioners. I have been asked to testify before the House and Senate Judiciary Committees of the Maryland General Assembly on matters of criminal law and evidence, and have counseled the writing staff of NBC’s Law and Order: Special Victims Unit on the perspective of a defense attorney in a sex crimes case and on technical accuracy of potential script ideas.In January 2024 I completed the Maryland State Bar training course in Mediation. After 40 years of advocacy I am now expanding my practice to include mediation of civil cases. Over the past 40 years of litigation practice –17 representing plaintiffs and 23 representing defendants -- I have developed a strong understanding of both the plaintiff and defense perspectives. I have tried over a hundred jury trials to verdict and fully appreciate the costs and uncertainty of taking a case to verdict. I also have extensive experience dealing with issues unique to multi defendant cases.
