About Tim Brooks
I am a senior lawyer in ASIC’s Investigation & Enforcement - Enforcement and Compliance Team. I lead large and complex investigations (both criminal and civil) primarily into suspected contraventions of the Corporations Act and ASIC Act, concerning financial services and credit provided by regulated entities. I supervise the work of junior staff on larger investigations, while also working autonomously on smaller matters. As a senior lawyer, I have responsibility for the overall project management of investigations, in which I proactively identify legal, policy and technical issues. I provide strategic legal advice to enforcement teams, by interpreting and applying legislation and policy, with an end goal being the commencement of civil litigation or the referral of a brief to the Commonwealth Department of Public Prosecutions. In my role, I have developed experience in engaging with and reporting to senior executive staff and Commission, including making recommendations and using my communication skills to influence decisions. While managing investigations, I have experience with the application for, and execution of, search warrants, the drafting of statutory notices, and conducting interviews and compulsory examinations. I am required to demonstrate strong analytical skills and excellent writing and drafting skills.I spent 15 months on secondment with the Commonwealth Director of Public Prosecutions as a Senior Federal Prosecutor. This involved assessing briefs of evidence received from investigative agencies, providing legal advice and guidance to agencies, making recommendations to commence prosecutions, appearing as an advocate in the Local Court, and instructing Counsel in indictable proceedings. Prior to my time at ASIC, I have experience in private practice, specifically in insolvency and civil litigation. Outside of my professional life – I am interested in staying healthy and going on bushwalks and adventures with my dog, am a regular blood and plasma donor, and am involved in my local soccer association judiciary as a voluntary panellist on disciplinary hearings.

Senior Federal Prosecutor (Secondment)
I was seconded to the Commonwealth Director of Public Prosecutions as a Senior Federal Prosecutor in the Serious Financial and Corporate Crime - Fraud and Specialist Agencies Division. This role involved assessing briefs of evidence received from investigative agencies, and assessing the evidence against the Prosecution Policy of the Commonwealth to recommend whether criminal proceedings should be initiated. I also appeared as a List Officer in the Local Court, and instructed Counsel in indictable proceedings in the District Court. I was also the assisting officer in a 10 month jury trial which resulted in a conviction.My work involved instructing Counsel, preparing Court documents and correspondence, reviewing and analysing evidence, and undertaking legal research to assist Counsel. The trial was run as an e-trial by the CDPP team, which is novel for criminal trials. This gave me invaluable experience with the technology available for e-trials.
