Tom Jensen provides litigation and regulatory counsel, legislative and executive branch advocacy to clients in the environment, energy, and natural resources sectors. With considerable experience in and deep knowledge of environmental and resources law, Tom delivers sophisticated counsel to clients involved with electric transmission projects, energy and water pipelines, transportation facilities, hydropower and other energy generation assets, and other capital-intensive infrastructure projects. Tom currently serves as lead outside litigation and regulatory counsel to a major interstate electric transmission project and recently represented a major interstate natural gas pipeline project before the U.S. Supreme Court and in appellate court litigation. A nationally recognized practitioner of natural resources and environmental law, Tom advises clients throughout the business, government, and nonprofit sectors, reflecting his credentials in both the legal industry and the public sector. He served as the majority counsel to the U.S. Senate Committee on Energy and Natural Resources and was the associate director for natural resources on the White House Council on Environmental Quality. During his time working in the public sector, Mr. Jensen helped to reform federal water policy and projects in California and other western states, resolve American Indian tribal treaty disputes, reform wildlife refuge and other public land policies, and oversee restoration efforts involving the Grand Canyon, Everglades and Elwha River. He has drafted dozens of pieces of legislation ultimately enacted into federal law. He led Administration-wide initiatives regarding Fifth Amendment "takings" policy.Developers of innovative, challenging energy projects and new environmental initiatives seek out Tom’s guidance for his insight into protected natural and cultural resources, public lands and marine areas, takings law, and the National Environmental Policy Act. A key player in helping clients develop and defend their project strategies, Tom leads teams involved in siting, property and right-of-way acquisition, federal, state, tribal, and local permitting, settlement negotiations, and litigation.Tom speaks frequently on environmental issues, from protected species mitigation to siting strategy, water development, water quality, climate adaptation, and marine energy development. He also writes and speaks on the conservation of at-risk wildlife and western rangelands.

When challenged, I defend those decisions in federal litigation. It is a transactional practice in the sense that the transactions are hard decisions by federal policy makers and lawyers on complex matters. My practice shifts to litigation when agency approvals are challenged in federal court. Much of my work today involves electric transmission projects--vital infrastructure for the energy transition that nevertheless often draws aggressive opposition.I regularly represent developers of energy projects in efforts to gain and defend federal permits to cross federal lands. Much of my work involves negotiating mitigation agreements with public- and private-sector stakeholders, including climate change-related measures. I counselled the leading international developer of floating wind technology, and supported all aspects of their business in the US. I advised industry-leading mining interests on sage-grouse conservation strategy and private developers of conservation banks. I advise electric grid and generation operators on migratory bird and endangered species issues. I served as hydropower licensing counsel to the Nation's largest public utility, secured the nation's first federal hydrokinetic power license (Makah Bay), and represented stakeholders in many hydropower regulatory proceedings. I counsel Indian tribes on water and natural resources. I am often involved with FAA and ACHP regulatory compliance challenges. When needed, I lobby as part of comprehensive advocacy efforts, and help design public communications campaigns. I mentor younger lawyers and try to honor the better traditions of the legal profession. -
