FSA/FCA Section 166 review of historic interest rate derivative contract sales for Lloyds Banking Group. Products under scope included Vanilla, Callable Swaps, Swaptions and Caps plus combinations of products to provide tailored/structured solutions to clients.

• FSA instigated review of historic investment complaints on holistic basis evaluating attitude to risk framework, KYC, and general suitability based on FSA guidelines using customer profiling of previous investment.
• Involved review of high net worth clients and inheritance tax planning advice including various trust based solutions. Implementation of new approach with emphasis on TCF involving work shop driven case discussion.
• Also dealt with cases involving pension transfers and sale of hedge fund products including forex swaps for international wealth clients. Heavy emphasis on client contact to qualify understanding, circumstances at the.

Review of PPI sales followed by calculation of redress.

• Handling complaints on a cradle to grave basis. Areas covered were mortgage related including general advice (inc financial hardship & irresponsible lending), commercial mortgages and also investment/pension related.
• Investment complaints involved review of all point of sale documentation to assess suitability and KYC criteria. Typical products included OEIC’s, investment bonds, both vanilla and structured along with transactions.

• Review of initial investigation in light of FOS adjudicator view, preparation of file and HBOS initial view outlining position. Covered PPI sold in conjunction with loans, credit cards and some mortgage protection.
• Required to assess different aspects of the investigation including calculation of the offer, letter quality, systems completion and regulatory reporting with feedback provided to reviewer.

Aylesbury, Equitable Life

• Review of supporting documentation for annuity book being transferred to Canada Life. Involved cross reference of internal systems to ensure correct documentation on file to support policy.

Quality check of data input by Barclays review staff in an exercise to amalgamate three different information systems onto one platform enabling accurate financial reporting in line with Sarbanes Oxley/Basel II international reporting standards.

General regulated complaint handling - Workstreams covered included investment trusts, OEIC, precipice bonds and with profits investments within products including ISA’s, personal pensions and investments bonds. Also included complaints against annuity advice and sale of split capital investment trusts, (zero’s in particular), following publicity over.
