I am Senior Counsel in Sklar Kirsh's Litigation Practice Group. I practice in the areas of business litigation, real property, food and supplement labeling, regulation, and safety, and products liability, primarily pharmaceutical products and medical devices. I represent my clients not only as a litigator, but as a counselor in risk avoidance and mitigation. I represent clients in federal and state courts, arbitrations, and mediations. I have tried, arbitrated, and mediated commercial lease disputes, environmental contamination and CERCLA matters, disputes over state and municipal regulatory overreach, business disputes, product liability and personal injury defense, civil fraud, and insurance coverage disputes. I have also served as a volunteer city attorney and county deputy district attorney, serving as lead prosecutor in a number of misdemeanor criminal jury and bench trials as well as evidentiary hearings.

Represented small and medium sized businesses, defending them in consumer suits and representing them in disputes with other businesses. I also represented them in their dealings with all kinds of government entities – local, state, and federal, protecting them against intrusive, capricious applications of regulations. Advised and defended food, supplement, and cosmetic manufacturers against putative classes of consumers claiming to have been misled by some aspect of a food, cosmetic, or supplement label or other aspects of the companies’ marketing and product descriptions. Represented pharmaceutical and medical device manufacturers in multi-district federal litigation and coordinated proceedings in California where there may be thousands or even tens of thousands of individual plaintiffs.

Represented food and specialty products retailer in variety of disputes, microprocessor manufacturer in antitrust actions, telecom company in dispute over fiber-optic cables laid in railroad rights of way, hospitality conglomerate in suit by owner of many hotel properties, large annuity and life insurance company in suit against purchaser of contested bonds, among many other interesting cases that were usually bet-the-company matters for the clients.
