I act as in-house coverage counsel for complex and high-exposure title insurance claims, including tenders of defense and claims involving potential mortgage and title fraud, subdivision law violations, super-priority liens, possessory rights, building and zoning compliance issues, encroachments, and solicitor negligence. In the event of claims-related litigation, I select and work closely with local counsel across jurisdictions to manage and direct the litigation, including reviewing and approving any substantive pleadings or motions and providing settlement authority when appropriate. I also regularly participate in pre-trial mediations and settlement conferences on behalf of the title insurer. Additionally, I am responsible for training junior lawyers on both the underwriting and claims teams with respect to policy coverage issues and internal claims-handling procedures; managing relationships with local counsel and industry professionals for purposes of efficient claims resolution and business development; flagging claim trends and changes in case law to underwriting counsel for further evaluation and recommend policy revisions; and regular reporting to major clients such as institutional lenders and to the US legal team.
