In most cases buyers will purchase a property ‘voetstoots’ based on esthetical observations, but hardly ever will a proper technical / structural inspection be requested. This may result in regret, that in almost all cases will be a very expensive learning curve. The onus remains on home buyers to satisfy themselves that the property is not defective in any form. Failing to do so may result in the insurance rejecting related claims because “Your insurance company will not cover you for maintenance”. The “Voetstoots / As Is” clause, simply means that the seller are not liable for patent / latent defects. it protects the seller but NOT the buyer! Having a property inspection done BEFORE signing an “Offer to Purchase” will also protect the buyer. Two exceptions that entitles the buyer to cancel the contract / to sue for a reduction in the selling price are If the seller knew of the defects and did not disclose them to the buyer & fraudulent, or innocent, material misrepresentation – but only if it can be shown that the latent defect is so serious that if the buyer had known of it he would not have bought. A PATENT DEFECT is a defect that is / should be easy to identify during an inspection whilst a lATENT DEFECT is A defect which is not apparent with an ordinary inspection by a ‘reasonable man’, & which only an expert would be expected to discover. a home inspector still relies on his observation(s). Therefore, a home inspection does not constitute a warranty.
