Mediation Mediation is a voluntary, confidential, informal, and cost-effective process that allows disputing parties, acting in good faith and conducting themselves in a forthright manner, to participate in opportunities by taking control of the problem solving process to attempt to reach a compromise Arbitration Arbitration is a non-judicial process for the settlement of disputes where an independent third party – an arbitrator – makes a makes a decision that is binding. The role of an arbitrator is similar to that of a judge, though the procedures can be less formal and an arbitrator is usually an expert in their own right. MedArb In a Med-Arb process encourages the disputing parties and counsel to focus their legal analysis on facts or finding of facts that are in dispute, on evidence in support of facts in dispute, applicable law principles that flow from facts in dispute (collectively referred to as the “Legal Elements”), and not lose sight of the importance on factors outside of the Legal Elements of a dispute (the “Non-legal Elements”).
