We also assisted our client with a range of issues arising out of the administration including litigation against the directors and advisors of the company for breach of trust and breach of directors’ duties• acting for the liquidators of a listed company in a claim for professional negligence and breach of fiduciary duties against the company’s former auditors• acting for the controlling trustee of a personal insolvency agreement as appointed by a former property developer. This complex matter involved applying for an extension of the convening period, dealing with queries raised by creditors opposed to the agreement, advising on the validity of creditor claims, and defending an application to set aside the agreement• advising and appearing for bankruptcy trustees in compelling cooperation from recalcitrant bankrupts and realising real property (and other) assets for the benefit of unsecured creditors• advising, litigating and making significant recoveries of unfair preference payments in the liquidation of a range of corporate insolvencies, including a tile and carpet wholesaler Show less
