Efforts ceased ≈$2B compulsory over-procurements harming climate transition strategy & operations; model spurred NC legislation reforming over-payments to generators. ➙ Developed litigation strategy that achieved approval of rate component to prevent under-recovery of ≈$1B wholesale service costs – averting customer’s deployment of stored energy at peak demand to avoid capacity costs.➙ Recovered ≈$1B (20% of ≈$5B) coal combustion residual remediation costs from wholesale customers; led legal effort to renegotiate rates; obtained FERC approvals for settlements. ➙ Avoided significant restatement liability by achieving settlement for wholesale depreciation rate case – mediation with customers / regulatory agency resolved multiyear litigation. ➙ Led wholesale legal effort for FERC’s approval of Duke Energy’s $1.25B purchase of NCEMPA’s ownership interest in nuclear & coal plants; secured emissions-free nuclear units and paved way to retire coal units; negotiated ≈$30B requirements contract to supply needs served by acquired assets. ➙ Led Progress Energy’s Kentucky PSC stake in merger with Duke Energy – secured approval; facilitated merger. ➙ Structured / negotiated 10K+ MW solar development agreements; set risk policies; developed teams / staff. ➙ Established Board-approved Dodd-Frank Swaps & Financial Transactions Compliance program.
