A damaged reputation can lead to organisational demise. Claims of sexual harassment, thefts and inappropriate behaviour cause damage. But with a robust and structured approach to investigations and grievances you can reduce the risk. Below are a couple of cases I have resolved;★The Problem:An employee was using the company’s vehicle without the employer’s permission. This resulted in the car being unavailable for company business which affected the company’s reputation and ability to provide an adequate service. ★The Solution:An investigation/fact-finding was carried out to establish the facts and recover evidence to support or negate the allegation. In this case, evidence was recovered that supported the claim and revealed that this was standard practice amongst all employees.The company was advised to conduct a disciplinary meeting to allow the employee to be represented and to provide mitigation before deciding on a sanction. ★The Problem: A supervisor and a member of their team had a dispute over using a mobile phone during working hours. The company had a policy that mobiles are only used during breaks. The team member (TM) felt racially discriminated against and took a period of sickness. The team’s performance and moral suffered as staff supported the supervisor or their TM.★The Solution: The mediation revealed deep-seated feelings which were the cause of the dispute. The TM did not like the supervisor dip sampling their work or monitoring the way they dealt with customers. The TM felt uncomfortable because they believed they were the only one being scrutinised. Conversely, the supervisor felt that the TM was not receptive to feedback, was defensive and spent a lot of time on Facebook. A workable agreement resulted in a return to work and repaired the team dynamics. I developed a rapport with both parties which led to a common outcome. They were able to listen to each other and this led to an understanding of each other’s role and intentions. Each party were able to step into the other person’s shoes and look at the dispute from different angles. The TM now understands the dip sampling, and monitoring protocols is to improve and recognise good performance. The supervisor accepted that the TM was using their mobile to monitor their child’s Facebook activity and was not avoiding work.★ The mediation took two days to complete as opposed to two months the dispute had lasted.★ The mediation cost less than litigation and ET fees and did not affect the organisation’s reputation.
