Chris is a litigator who focuses on resolving disputes for clients in complex commercial and technology-related matters. Clients seek his counsel in such areas as breach of contract, the Uniform Commercial Code, equipment leasing, business torts, and intellectual property. Chris has handled all phases of litigation in state and federal court and before arbitration tribunals, including pre-litigation investigation, motion practice, discovery, expert witnesses discovery, trial and appeal.Chris has represented purchasers and suppliers in litigated and non-litigated disputes regarding the purchase and sale of goods, including disputes involving breach of warranty, failure to make payments, termination of supply agreements, and commercial impracticability. He has also counseled major corporations regarding best practices when contracting under the UCC, including review of contracting procedures and contract forms. Chris has written and spoken extensively about these areas, including articles on breach of warranty and electronic contracting under the Uniform Electronic Transactions Act and the federal E-SIGN statute.Chris has also represented four electric utilities in litigation against the United States Department of Energy (“DOE”) seeking damages for breach of contract related to DOE’s failure to accept and dispose spent nuclear fuel from these client’s nuclear reactors. One of these cases, brought on behalf of Exelon Generation LLC, settled in August 2004 on favorable terms for the client. Recently, client Energy Northwest was awarded $56.8 million in its lawsuit against DOE.
