David provided sound coverage advice and drafted coverage opinions for insurance companies to help them interpret Multiple Peril policies, Directors and Officers policies, Business Auto policies, and Garage Keepers policies. David's clients came to him with some of their most difficult insurance coverage issues, and he successfully navigated them to a successful result. David served as lead counsel representing insurers in declaratory judgment litigation in state and federal courts across the country. In the past six months, David successfully briefed and argued summary judgment motions in the federal district courts in Phoenix, Arizona and Kansas City, Missouri. David represented insurers in extra-contractual insurance litigation, including so-called “bad-faith” failure to settle within policy limits. David also drafted appellate briefs and presented oral argument in state and federal appellate courts. In the past year, David successfully briefed and presented oral argument in the Ninth Circuit and persuaded the court that the California court lacked personal jurisdiction over my clients.David was the "go-to" attorney at Ruberry, Stalmack & Garvey, LLC. David represented insurers on variety of issues pertaining to commercial general liability coverage disputes. Litigated complex professional liability insurance coverage cases involving a variety of issues, including but not limited to the business enterprise exclusion and the failure to settle within policy limits. David represented policyholder defendants in complex defamation and conspiracy litigation from inception through dispositive motions, including litigation over the Illinois Strategic Lawsuit Against Public Participation (“SLAPP”) Act.

David handled all aspects of complex civil litigation, business torts, and negligence cases from inception through appeal, including but not limited to Section 1983 litigation against municipalities and their police officers, class actions, employment and privacy litigation in state and federal courts and federal and state agencies. He also represented insurers in CGL-related coverage disputes, from dispositive motions through appeal. David litigated every kind of commercial dispute through all aspects of the litigation process, from developing the litigation strategy through its implementation.

Represented first party property insurance carriers in multi-million dollar property subrogation cases involving allegations of architectural and engineering malpractice. Handled disputes over subrogation waivers, risk-of-loss, contractual indemnification and insurance-procurement contractual clauses. Coordinated, supervised, and participated in extended out-of-state document reviews.

David supervised a staff of 30 contract attorneys who performed the review of attorney fee invoices.

David represented multi-employer pension plans and unions in delinquent contribution and withdrawal liability litigation nationwide.David first chaired multiple bench trials in federal district court and bankruptcy court for delinquent ERISA contributions and withdrawal liability. David wrote and argued over 30 appeals in the federal and state appeals courts, and drafted three certiorari petitions for the United States Supreme Court. David also litigated multiple bankruptcy cases, including several claims estimation hearings, debtors’ motions to reject collective bargaining agreements, and adversary cases challenging debtors’ discharge.
